Legal system

Mauritius operates a hybrid legal system combining English common law and French civil law (the Code Napoléon). This reflects the island's colonial history under both Britain and France. The court hierarchy runs from the District Court to the Supreme Court, then the Court of Civil Appeal, and finally the Privy Council in London as the final court of appeal. The Bar Council of Mauritius (barcouncil.mu) regulates all attorneys practising on the island.

Property law

All property transactions in Mauritius must be conducted through a Notaire (notary). The notary prepares the deed of sale, conducts title searches and registers the transfer at the Registrar General. Foreign nationals may only purchase property within approved IRS, RES, PDS or Smart City developments — standard Mauritian residential property is not available to non-citizens without specific exemption.

Immigration & visa law

Work permits and Occupation Permits are issued by the Passport and Immigration Office (PIO) and the Economic Development Board (EDB). The Premium Visa is managed online through a dedicated government portal. Most legal firms dealing with expats can assist with permit applications and renewals. Immigration law changes frequently — always use a current source.

Company law

Mauritius company law is governed by the Companies Act 2001. All companies must be registered with the Registrar of Companies. Most legal firms handle domestic company formation. For Global Business Companies, a licensed Management Company is required and the Financial Services Commission (FSC) must approve the structure. Legal firms frequently work alongside Management Companies and accountants on GBC matters.

Family law

Divorce and family matters are handled in the Family Division of the Supreme Court. Mauritius applies French-influenced matrimonial property law — the community of property regime is the default unless a prenuptial contract (contrat de mariage) specifies otherwise. Expats should take legal advice before and on marriage regarding the matrimonial property implications.

Dispute resolution

MARC — the Mauritius International Arbitration Centre — provides commercial arbitration and mediation services as an alternative to the courts. MARC is well regarded internationally and awards are enforceable under the New York Convention. Commercial parties frequently include MARC arbitration clauses in international contracts.
